Italian Court Glossary

Check out the main terms that may appear during the monitoring of a judicial process in the Giustizia Civile app. These statuses provide valuable information about the progress of cases and the next steps, promoting greater transparency and understanding of the Italian judicial system. It’s important to note that these are the most common statuses when consulting cases filed in Italy, especially in cases of recognition of Italian citizenship through the courts. However, not all statuses will be displayed in every case, as each one has its own specifics.

We list them in alphabetical order to make your search easier.

ACCOGLIMENTO TOTALE:

Indicates that all terms of the initial petition were accepted, resulting in a fully favorable ruling. This update is a reason for celebration for the petitioner, as their case has been entirely accepted by the court.

ANNOTAZIONI:

This status is assigned when the Court Registry makes annotations in the case. These notes may contain relevant information or administrative records of the case.

ANTICIPAZIONE UDIENZA:

Means that a hearing has been brought forward, i.e., the initially scheduled date was changed to an earlier one. This can happen for various reasons, such as the need to expedite the process or the availability of all involved parties.

APERTURA SUB-PROCEDIMENTO DI CORREZIONE ERRORE MATERIALE:

Indicates that a sub-procedure has been initiated to correct a material error in the ruling. These errors may relate to names, surnames, dates, or other relevant details of the case.

ASSEGNAZIONE A SEZIONE:

This status informs that the case has been assigned to a specific section of the court, which will be responsible for handling the case.

ASSEGNAZIONE AUTOMATICA A SEZIONE:

Similar to the previous status, but in this case, the section assignment was done automatically by the system, without human intervention.

ATTO NON CODIFICATO:

Refers to a judge’s procedure that was carried out outside of a hearing. It may be a specific action necessary for the progress of the case.

CONCESSA AUTORIZZAZIONE ALLA CONSULTAZIONE DEL FASCICOLO:

This update informs that authorization has been granted to consult the case file. This may be related to people or entities that need to access case details.

CORREZIONE CONTRIBUTO UNIFICATO E VALOR CAUSA:

Indicates that there has been a correction in the court fees and/or the case value. This is important to ensure that the fees and values are correct and updated.

COSTITUZIONE PARTI:

This status is assigned when one of the parties involved in the action (for example, the Ministry of the Interior) has officially entered into the process, meaning they have made their formal representation.

DEPOSITO ATTO NON CODIFICATO:

This update indicates the filing of documents in the course of the case. Additional documents may be submitted to support the case.

DEPOSITO MEMORIE:

Refers to the filing of written statements or arguments prepared by the client or lawyer. This step is important to present a written defense before the court.

DEPOSITO MINUTA SENTENZA DEFINITIVA:

This update informs that we are awaiting the publication of the final judgment. The ruling will be made available after the conclusion of the trial.

DESIGNAZIONE AUTOMATICA GIUDICE:

In this status, a judge has been automatically assigned to judge the case. This process is conducted automatically by the system.

DESIGNAZIONE GIUDICE:

Similar to the previous status, but in this case, the judge was manually assigned to the case.

DIFFERIMENTO UDIENZA:

This status indicates that the hearing has been postponed, meaning its realization has been delayed to a later date.

FISSAZIONE UDIENZA DI COMPARIZIONE PARTI:

Here, a hearing date is set for the appearance of the parties. If the lawyer has power of attorney from their clients, they do not need to be present at the hearing.

FISSAZIONE UDIENZA DI CORREZIONE ERRORE MATERIALE:

This update informs that a hearing has been scheduled to correct a material error identified in the case.

ISCRIZIONE RUOLO GENERALE:

Indicates that the case has been registered with a general case number at the court. This number allows for the consultation of the case through the Italian Justice APP.

INVIO ATTI ALL’AGENZIA DELLE ENTRATE:

This update informs that the case files have been sent to the Revenue Agency (Tax Office) for registration procedures.

INVIO SENTANZA AL PRESIDENTE PER FIRMA:

In this status, the judgment has been sent to the president for signature before its publication.

PASSAGGIO IN ARCHIVIO:

Indicates that the case has been archived, meaning the documents have been removed from the court’s active files. This usually happens with older cases.

RIGETTO:

Refers to a rejection status, indicating that the case has been dismissed by the court.

RIMESSIONE FASCICOLO AL GIUDICE PER LA DECISIONE:

This status informs that the case has been sent to the judge for a decision. The judge will analyze the evidence and arguments presented before delivering their ruling.

RINVIO AD ALTRA UDIENZA DI COMPARIZIONE:

This update indicates that a new hearing for appearance has been scheduled.

RISERVA:

When the case is in “riserva,” it means the files are with the judge, who is preparing to make a decision. The judge is reviewing the case details before issuing a ruling.
